Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 2 to 4 to cancel / withdraw the lookout circular issued against the petitioner's husband and father, namely, Azarudeen and Mohamed Sulthan in connection with FIR in Crime No.02 of 2024 on the file of 3rd respondent police. ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 2 to 4 to cancel / withdraw the lookout circular issued against the petitioner's husband and father, namely, Azarudeen and Mohamed Sulthan in connection with FIR in Crime No.02 of 2024 on the file of third respondent police.
2. The learned counsel appearing for the petitioner submitted that the FIR has been taken on file in Spl.C.C. No. 4 of 2026. The petitioner's husband has 2/5
received summons to appear before the trial Court. The petitioner is the victim under the POCSO Act in the said case. Now, both the victim and the accused wants to compromise the matter. Therefore, the petitioner, being the wife, seeks withdrawal of the Look Out Circular.
3. Considering the above facts, this Court is inclined to entertain the writ petition. The Look Out Circular is kept in abeyance. The petitioner shall surrender her passport before the concerned Court and attend the hearings. The concerned Judicial Magistrate, after completion of the proceedings, may consider returning the passports.
4. M/s. Ummusalama has appeared before this Court as an intervenor. It is brought to the notice of this Court that there is another case against the petitioner accused in Crime No. 126 of 2023, which is pending investigation, and a warrant has been issued against Azarudeen. The intervenor seeks protection in the event the Look Out Circular is set aside. It is seen that A-2 and the intervenor are neighbours. In case A-2 resides in the said locality, the intervenor apprehends threat or assault from Azarudeen.
5. Considering the same, the said Azarudeen shall not enter the street, 3/5
house, school/college, or any place where the intervenor is residing.
