Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to Suspend the substantial Sentence passed against the Petitioner/Accused above named in Crl.A.No.88 of 2017 by the order dated 22.01.2020 rendered by the Additional District and Sessions Judge, Sivagangai by reversing the order of acquittal passed by the Judicial Magistrate No.I, Sivagangai in C.C.No.255 of 2015 dated 09.06.2017 and enlarge the petitioner on bail pending disposal of the Criminal Revision.

Prayer in CRL MP(MD). 338/ 2021 :

To grant exemption to the petitioner from surrendering to custody pursuant to the order of conviction and award of sentence rendered by the Additional District and Sessions Judge, Sivagangai in Crl.A.No.88 of 2017 vide order dated 22.01.2020 by reversing the order of acquittal passed by the Judicial Magistrate No.I, Sivagangai in C.C.No.255 of 2015 dated 09.06.2017 pending disposal of the Main Revision.

To call for the records and set aside the order of conviction and sentence rendered by the Additional District and Sessions Judge, Sivagangai in Crl.A.No.88 of 2017 by his order dated 22.01.2020 and confirming the order passed in C.C.No.255 of 2015 Judicial Magistrate No.I, Sivagangai dated 09.06.2017. Order : These petitions coming up for orders on this day, upon perusing the petitions filed in support thereof and upon hearing the arguments of Mr.N.ANANTHAPADMANABHAN, Advocate for M/S.APN LAW ASSOCIATES for the petitioner and of Mr.A.V.ARUN, Advocate on behalf of the Respondent, the Court made the following order:- On the side of the petitioner, it is stated that the petitioner could not mobilise the fund and prayed one month time for complying the condition.

2. At the request of the learned counsel for the petitioner, three weeks time is granted from the date of receipt of a copy of this order.

3.This Petition is allowed accordingly.
