Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a writ of Mandamus directing the respondents 1 to 6 to forbear the 7th and 8th respondents, their men and agents from performing kumbabisekam or

conducting the temple festival of Arulmigu Sri Kaliamman Temple situated at Sundankulam Village, Alangulam, Vembakkottai Taluk, Virudhunagar District as against the orders of the Learned Sub Ordinate Judge, Sivakasi dated 07.09.2015 in I.A.No.40/2015 in A.S.No.13/2015 and ensure the peaceful worship of the temple by the village people by provinding police protection in all auspicious and other days.

ORDER:

Writ Miscellaneous Petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.K.Kannan, Advocate for the Petitioner and of Mr.K.Suyambulinga Bharathi, Government Advocate for the respondents 1 to 6, this Court made the following order:

This Court, by an order dated 30.05.2019, dismissed the writ petition for non-prosecution.

2. According to the petitioner, when the matter was taken up for hearing during the vacation Court on 16.05.2019, it was adjourned after vacation and after vacation, the petitioner was informed that the matter has been listed in the last vacation Court on 30.05.2019 and it was dismissed for non-prosecution on the same day. Hence, in order to restore the same, the present petition has been filed.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the restoration petition is ordered and the W.P.(MD).No.11041 of 2019 is restored and post the matter next week.
