Prayer in CRL RC(MD). 198/ 2023 :

To call for the entire records pertaining to the order passed by the Court of the Judge, Family Court, Madurai District in MC No.29/2014 vide order dt/4/1/2023 and quash the same as illegal.

Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.DHILIPAN PANDIAN R L, Advocate for the petitioner and of M/s.INDIRA, Party-in-person on behalf of the Respondent, the Court made the following order:- This Court, by order dated 20.06.2023, has granted an order of interim stay with a condition that the petitioner shall deposit 50% of arrears amount of maintenance https://www.mhc.tn.gov.in/judis pending as of now, on or before 24.07.2023 and continue to deposit 75% of the

monthly maintenance amount awarded by the trial Court till the disposal of the criminal revision case.

2. Today, when the matter was taken up for hearing, without complying the conditional order, the learned counsel for the petitioner seeks an adjournment.

3. In view of the non-compliance of the conditional order passed by this Court on 02.06.2023, the interim stay already granted by this Court stands vacated. Accordingly, this Criminal Miscellaneous petition is dismissed.
