ORDER : The Court Made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 12.10.2015 for the alleged offences punishable under Sections 448, 376 of IPC and 5(L)(U) r/w 6 of POCSO Act, in Crime No.17 of 2015, on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that on 11.09.2015 the petitioner went to the defacto complainant's house and on giving false promise to marry the defacto complainant's daughter, he had sexual intercourse with the daughter of the defacto complainant and he continued the same on various dates. Therefore, the case has been registered for the above said offences.

3.The case of the petitioner is that he is an innocent person and he has not committed any offence as alleged by the prosecution. Because of the said complaint given against the petitioner, the father of the petitioner was committed suicide on 29.10.2015. The petitioner is studying diploma course and both the petitioner and the victim girl are lovers, which was objected by the father of the de-facto complainant. Due to that, a false complaint has been given against the petitioner. 4.The learned Government Advocate (Crl.side) submitted that the investigation has been completed and the charge-sheet has been filed.

5. Considering the facts and circumstances of the case and also considering the fact that the charge sheet is filed and the petitioner was arrested on 12.10.2015 and he is in judicial custody for more than 60 https://hcservices.ecourts.gov.in/hcservices/

days, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge, Mahila Court, Virudhunagar District at Srivilliputhur and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. sd/- 14/12/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
