PRAYER :- For Bail in Crime No.18/2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 22.01.2022 for the offences punishable under Sections 174(3) IPC @ 306 IPC, in Crime No.18 of 2022 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the deceased Rekha was married with one Murali and she borrowed Rupees one lakh from the petitioner. Since she was not able to return back the said money in time, the petitioner tortured the deceased by asking his money back, she committed suicide. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the husband of the deceased borrowed money from the village people and due to that there was family quarrel between the deceased and her husband. He would further submit that this Court has dismissed the earlier application in Crl.OP(MD) No.09.02.2021. https://hcservices.ecourts.gov.in/hcservices/ 1/2

No.3586 of 2022 4.The learned Additional Public Prosecutor appearing for the State would submit that the deceased borrowed a sum of Rs.1,00,000/- from the accused and repaid a sum of Rs.60,000/- and that the petitioner demanding the remaining amount, has been harassing her. Moreover, he would further submit that there existed extra martial affair between the deceased and the accused and that since the deceased had refused to accept his demand for sexual relation at a particular point of time, the petitioner had threatened and harassed her.

5.Considering the seriousness and gravity of the offence alleged and also the fact that the investigation is pending, as stated by the learned Additional Public Prosecutor and there is no change in circumstances, since the dismissal of the earlier petition for bail, this Court is not inclined to grant anticipatory bail to the petitioner.
