ORDER

The petitioners, who are A1, A2 & A4 in Crime No.67 of 2017 pending on the file of the first respondent police, has filed this petition to quash the said proceedings.

2.The case of the prosecution is that the petitioners along with other accused persons have trespassed and attacked the second respondent and also abused him in filthy language. 3.This Court, vide order dated 21.03.2025, has granted interim order restraining the respondent Police from filing the final report alone. Today, this matter is listed under the caption "Extension of Interim Order". When the matter is taken up for hearing, in the morning session, there is no representation for the petitioners and hence, this case is passed over for final disposal, since the learned Government Advocate(Crl.side) submits that he is ready with the case. In the afternoon session also there is no representation for the petitioners. 2/5

4.The learned Government Advocate(Crl.side) appearing for the first respondent submits that the investigation in Cr.No.67 of 2017 has been completed and charge sheet also made ready. However, they are not in a position to file it, in view of the interim order passed by this Court.

5.Since it is reported that the investigation has been completed and charge sheet has also been made ready, this criminal original petition is disposed of with a direction to the first respondent Police to file the final report, within a period of one week from the date of receipt of a copy of this order. Mere filing of final report is not sufficient. It is the duty of the first respondent Police to ensure that the final report is taken on file, without any further delay. The petitioners are at liberty to challenge the final report, in the manner known to law. Consequently, connected miscellaneous petition is closed.
