PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the 1st respondent to consider the petitioners application for issue of fresh passport based on the application submitted by the petitioner in Reference No.261051584080 dated 31.01.2026 within a stipulated time that may be fixed by this Court. ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to consider the petitioner's application for issuance of fresh passport based upon his application dated 31.01.2026.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.23 of 2021 on the file of the second respondent which has culminated in filing of a charge sheet in S.T.C.No.200 and 2022 on the file of the learned Judicial Magistrate No.I, Sivagangai.

3. The learned Central Government Standing Counsel appearing for first respondent submits that the writ petition is premature in view the fact that the petitioner has only got an appointment with the first respondent.

4. Considering the above said facts, the petitioner is directed to approach the learned Judicial Magistrate No.I, Sivagangai, seeking permission of the Court to go abroad. In case if any such application is filed, the same shall be disposed of within a period of four weeks. Based upon the orders to be passed by the concerned trial Court, the first respondent is directed to proceed in accordance with law.

5. With the above said observations, this writ petition stands disposed of. No costs.
