ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 392 of IPC, in Crime No.363 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that when the defacto complainant was in the Tea Stall, the petitioner along with first accused came to the shop in Two Wheeler and snatched the two sovereigns of gold chain from the defacto complainant and escaped from the scene of occurrence.

3.The case of the petitioner is that he is an innocent person and he has not committed any offence as alleged by the prosecution and only on the confession given by the first accused, this petitioner has been falsely implicated in this case. The first accused was arrested and released on bail and the stolen articles are recovered.

4.The learned Government Advocate (Crl.side) submitted that the petitioner is the main accused and half of the jewels has to be recovered and if the petitioner is released on bail, he will tamper the witnesses and hamper the prosecution.
