(MD)No.1499 of 2018) PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order of the 1st respondent vide his proceedings in Na.Ka.No.40590/2017/G5, dated 31.08.2017 and quash the same as illegal, consequently direct the respondents to drop all further proceedings relating to cancel the Patta of the petitioner in Patta Number 2667 on the file of the 3rd respondent without issuing any notice to the petitioner.

ORDER
Heard the learned counsel on either side.
2.The revenue records in respect of the subject property stand in the name of the writ petitioner. Seeking its cancellation and for entering their names, the private respondents herein submitted an application. The application is presently pending before the second respondent. The second respondent is directed to conduct an enquiry and after hearing both the parties, and take a decision in accordance with law within a period of fourth months from the date of receipt of a copy of this order. It is made clear that the second respondent will not in any way be guided or swayed by the communication bearing Na.Ka.No.40590/2017/G5, dated issued by the District Revenue Officer, Madurai.
