ORDER : The Court Made the following order :- The petitioner/sole Accused, who was arrested and remanded to judicial custody on 08.10.2015 for the alleged offences punishable under Sections 417 and 376 of IPC, in Crime No.9 of 2015, on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that the petitioner by giving false promise of marrying the defacto complainant, he had sexual relationship with her. Due to the relationship, the defacto complainant got five months pregnancy.
3.The case of the petitioner is that he is innocent person and he has not committed any offence as alleged by the prosecution and a false case has been registered against the petitioner. 4.The learned Government Advocate (Crl.side) submitted that the petitioner on promising marrying the defacto complainant, had sexual relationship with the defacto complainant and she conceived and thereafter, he refused to marry her.
5. Considering the facts and circumstances of the case and also considering the fact that the alleged occurrence has taken place on 07.10.2015 and the petitioner is in judicial custody from 08.10.2015, this Court is inclined to grant bail to the petitioner with certain conditions. be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Vilathikulam and on further condition that the petitioner shall appear before the respondent police daily twice at 10.00 a.m., and 5.00 p.m., until further orders.
