O R D E R

This Writ Petition is filed seeking a direction to the 2nd respondent to register the sale deed dated 06.10.2023 in Temporary Reg No.TP/161642299/2023 in favor of the petitioner within a stipulated time fixed by this Court.

2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner submitted that when the petitioner presented a sale deed for registration, the respondents refused to register the same on the ground that there was an objection by one Paramanandham. Hence, the petitioner has filed this Writ Petition for the above said relief.

4. The learned Government Advocate appearing for the respondents would submit that since there was an objection, the respondents are not in a position to register the sale deed presented by the petitioner.

Considering the facts and circumstances of the case, this Court is of the view that if any document is presented for registration and any objection is received by the respondents from third parties with regard to the said property, instead of merely returning the document, the proper course is that, after receiving the document, the respondents are supposed to issue notice to the pattadhars and after hearing the parties, the respondents supposed to take a decision with regard to the registration of the said document. In the present case, the said procedure has not been followed by the respondents.

6. In view of the above, this Court directs the petitioner to re-present the sale deed before the second respondent. Upon such representation, the second respondent is directed to take the same on record and, if any objection is received, the 2nd respondent is directed to issue notice to the parties concerned and thereafter shall take a decision regarding registration of the sale deed in accordance with law. 3/6

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
