Prayer: Writ Petition is filed under Article 226 of the Constitution of India to issue Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order, dated 30.01.2021 on the file of the fourth respondent and quash the same as illegal and consequently directing the third respondent to grant permission to the petitioner to conduct the peaceful cycle rally from Kanyakumari to Chennai for creating the awareness of the education on 05.03.2021 or any other date within the time frame stipulated by this Court. ORDER
This petition has been filed seeking to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the fourth respondent, dated 30.01.2021 and consequently direct the third respondent to grant permission to the petitioner to conduct the peaceful cycle rally from Kanyakumari to Chennai for creating the awareness of the education on 05.03.2021. 1/3
2.The case of the petitioner is that he completed Master Degree in Business Administration and he is the brother of Late. Anitha, a student, who committed suicide in fight against NEET examination. After the demise of Anitha, his family members are struggling to improve the education systems and create awareness among the people of Tamil Nadu about the medical education. In this regard, the petitioner made a representation to the first respondent, seeking permission to conduct the cycle rally.
3.When the matter came up for hearing on 15.04.2021, it was reserved for orders and later, it is reopened for getting clarification, considering the present pandemic situation and the ban imposed by the Government of Tamil Nadu regarding the public movements.
4.The learned counsel for the petitioner would submit that a liberty may be given to the petitioner to make a fresh representation, after the pandemic period is over, to conduct the cycle rally to create the awareness. The same is also accepted by the learned Government Advocate (Criminal side). 5.Considering the present day pandemic situation, liberty is given to the petitioner to make a fresh representation on the above said ground for conducting the cycle rally.
6.With this liberty, the Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
