Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.N.RANJITH, Advocate for the petitioner and of MR.A.RAMAR, Additional Public Prosecutor on behalf of the Respondents the court made the following order:- The learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent Police are present.

2. A report 02.08.2017 from Judicial Magistrate, Theni, reveals the fact that the petitioner has appeared before the Court from 23.06.2017 to 31.07.2017 and failed to appear on 01.08.2017 and 02.08.2017.

3. The learned Additional Public Prosecutor submitted that charge sheet has been filed before the Judicial Magistrate, Theni, however, the same has not been taken on file.

4. Considering the facts and circumstances of the case, the absence of the petitioner on 01.08.2017 and 02.08.2017 is condoned in the interest of justice and the earlier condition is relaxed and the petitioner shall appear before the Court on receipt of summons. This petition is ordered accordingly.
