Prayer in CRL MP(MD). 1335/ 2017 IN CRL OP(MD)NO.21571/2016 : Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to condone the absence of the petitioner before the Honourable Judicial Magistrate, Eraniel in 25/01/2017 in Crl.O.P.No.21571/16 dated 24/11/2016 and pass such further or other orders as this Honourble Court may deem fit and proper in this circumstances of the case and thus render justice.

M/S.T.ARUL, Advocate for the petitioner in both the petitions and of MR.P.KANDASAMY, Government Advocate (Crl.side) in both the petitions on behalf of the Respondent the court made the following order:- The learned counsel for the petitioner is present. 2.A report dated 02.02.2017 received from the Principal District Munsif cum Judicial Magistrate, Eraniel, reveals the fact that the petitioner has complied with the condition from 15.12.2016 to 02.02.2017 except one day ie., on 25.01.2017 in respect of 8th petitioner.

3.The learned counsel for the petitioner submitted that since the 8th petitioner was taking treatment on 25.01.2017, he was not able to comply with the condition by producing the medical record. 4.Considering the facts and circumstances of the case, the absence of the 8th petitioner on 25.01.2017 is condoned and the condition is relaxed.
