O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to issue separate pattas in the name of the petitioners in respect of their properties comprised in S.Nos. 51/4D and 51/5, situated at Ramakrishnapuram Village, Andipatty Taluk, Theni District, as per their sale deeds in Document No.493 of 1995 and Document No.3596 of 2010, by considering the petitioners' representation dated 25.08.2025 within a time frame to be fixed by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The grievance of the petitioners is that they purchased the subject properties under two separate registered sale deeds. From the date of Page No. 2 of 5
purchase, they have been in joint possession and enjoyment of the subject properties. The patta in respect of the said properties stood jointly in a joint patta. For several years, the petitioners did not apply for issuance of separate pattas. Thereafter, the petitioners approached the third respondent on several occasions seeking issuance of separate pattas. However, the third respondent has not issued the pattas in the names of the petitioners. Subsequently, the petitioners submitted a representation dated 25.08.2025 to the respondents. However, no action has been taken on the said representation of the petitioners. Therefore, the petitioners have been constrained to file the present Writ Petition.
4. The learned Government Advocate appearing for the respondents, on instructions, would submit that the petitioners' representation dated 25.08.2025 would be considered and appropriate orders would be passed by the third respondent within a period of sixteen weeks.
5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioners' representation Page No. 3 of 5
dated 25.08.2025 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity of hearing to the petitioners and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
