ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b) and 324 of IPC, in Crime No. 126 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The learned counsel appearing for the petitioner submitted that due to ill health, the petitioner was unable to appear before the trial Court, hence, the trial Court has issued an NBW against the petitioner. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks to grant anticipatory bail to the petitioner.

3.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the offences committed by the petitioner are serious in nature.

4. The learned counsel for the Intervenor/defacto complainant has opposed for grant of anticipatory bail to the petitioner. 2/4

5. Considering the facts and circumstances of the case, this Court is directing the petitioner to surrender and submit a recall petition before the learned District Munsif cum Judicial Magistrate, Alangudi. Upon such a petition being filed, the learned District Munsif cum Judicial Magistrate, Alangudi, shall consider the petition in accordance with the law on its merits on the same date.

6.With the above said directions, the Criminal Original Petition is disposed of.
