O R D E R

The petitioner herein seeks a direction to the respondents 1 and 2 to grant separate patta in the name of the petitioner in respect of the property situate in S.No. 143/6, having an extent of 3780 sq.ft. in Gunappanadenal Village, Ilyangudi Taluk, Sivagangai District.

2. Heard the arguments of Mr.R.Murali, learned counsel for the petitioner and Mrs.S.Jeya Priya, learned Government Advocate appearing for the respondents.

3. According to the petitioner, he purchased the subject property under a registered sale deed dated 08.11.1999. The civil litigation involving the petitioner's vendor Arputham was also ended in favour of the petitioner in S.A.No.94 of 2022. In the said second appeal, the title of the petitioner's vendor was declared by the civil Court. On the strength of the registered sale deed and the judgment of the civil Court, the petitioner submitted a representation on 13.12.2021, before the respondents seeking subdivision and issuance of separate patta in respect of the property purchased by him. The same has not been considered. 2/4

Hence, the petitioner has come before this Court.

4. The learned Government Advocate appearing for the respondents would submit that if the petitioner makes a proper online application, the same will be considered in accordance with law.

5. In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to submit a proper online application before the second respondent within a period of two (2) weeks from the date of receipt of a copy of this order along with necessary documents. On filing of online application, the second respondent shall consider the same and pass final orders within a further period of eight (8) weeks, after giving notice to the petitioner and other interested parties.

6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
