Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The Petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 468, 471 and 420 IPC in Crime No.43 of 2014 on the file of the respondent police, seeks anticipatory bail.

2.This is second anticipatory bail petition and the first anticipatory bail petition in Crl.OP(MD)No.21246 of 2014 was dismissed by this Court on 04/12/2014 by a well considered order. 3.Learned counsel for the petitioner submits that the date of birth of the petitioner is 13/11/1992 and in all the documents, namely, birth certificate, school leaving certificate, election identify card and driving licence, his date of birth has been shown as 13/11/1992 and therefore, the allegation against this petitioner by the passport authorities is not sustainable. 4.On reading of the complaint lodged by the Passport authorities, it is seen that this petitioner has given a birth certificate dated 12/06/2009 purported to have been issued by the Village Administrative Officer of Erwadi Panchayat. The said certificate was referred to by the Passport authorities to the Panchayat and they have given a report that the certificate is a forged document.

5.Under such circumstances, this is not a fit case to grant anticipatory bail to this petitioner. Hence, the Criminal Original Petition is dismissed.
