Prayer: Writ Petition - filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 3rd respondent to expedite the enquiry based on the Memorandum issued by the 2nd respondent dated 30.10.2023 in Na.Ka.No.3008/2023/A3, in respect of issuance of separate patta to the petitioner for the land bearing S.No.584/1A1 of an extent of 9 3⁄4 cents situated at Kuchanoor village, Uthamapalayam Taluk, Theni District within a stipulated period as that may be fixed by this Court. 1/4

ORDER

This writ petition has been filed for issuance of writ of mandamus directing the 3rd respondent to expedite the enquiry based on the Memorandum issued by the 2nd respondent dated 30.10.2023 in Na.Ka.No.3008/2023/A3, in respect of issuance of separate patta to the petitioner for the land bearing S.No. 584/1A1 of an extent of 9 3⁄4 cents situated at Kuchanoor village, Uthamapalayam Taluk, Theni District within a stipulated period as that may be fixed by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader, who takes notice for the official respondents. By consent of both parties, this writ petition is disposed at the stage of admission itself.

3. The case of the petitioner is that enquiry with regard to issuance of separate patta is pending and therefore, the petitioner seeks for expeditious disposal of the pending enquiry.

The learned Special Government Pleader appearing for the respondents submits that the enquiry will be completed within the time frame fixed by this Court.

Considering the facts and circumstances of this case, this Court, without expressing any opinion on the merits of the matter, directs the respondents to complete the enquiry in Memorandum issued by the 2nd respondent dated 30.10.2023 in Na.Ka.No.3008/2023/A3, in respect of issuance of separate patta to the petitioner for the land bearing S.No.584/1A1 of an extent of 9 3⁄4 cents situated at Kuchanoor village, Uthamapalayam Taluk, Theni District, after affording an opportunity of hearing to the petitioner and any other necessary party, whom the respondents deem fit to put on notice, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above direction, the Writ Petition stands disposed of. No costs.
