PRAYER: Criminal Original petitions have been filed under Section 528 of BNSS to direct the learned Additional District and Sessions Judge, Pudukkottai to dispose the Sessions case in S.C.No.121 of 2023 within a reasonable time to be stipulated by this Court. This Criminal Original Petition has been filed seeking a direction to the learned Additional District and Sessions Judge, Pudukkottai to dispose the Sessions case in S.C.No.121 of 2023, within the stipulated time.

2.The learned Counsel for the petitioner would submit that he is the defacto complainant in this case and based on his complaint, a case in Crime No.52 of 2023 was registered for the offences under Sections 147, 294(b), 323, 324, 307 and 506(2) of IPC and subsequently, after demise of the petitioner's brother, the offence under Section 302 of IPC was added and now the case is pending before the Additional Sessions Court, Pudukottai in S.C.No.121 of 2023 and no trial has been concluded and after filing of this petition, the prosecution produced some witnesses for examination.

3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that in this case, witnesses P.W.1 and P.W.2 were examined. Lastly, the said witnesses were cross examined on 03.02.2025. Now the case is posted for examination of further witnesses. 2/4

The respondent police will co-operate for speedy trial by producing the witnesses as directed by the trial Court.

4.Since the case is pending for examination of witnesses and already some of the witnesses were examined, the learned Additional District and Sessions Judge, Pudukottai is directed to dispose of the case in S.C.No.121 of 2023 as early as possible without granting long adjournments beyond fifteen days.

5.With the above direction, this criminal original petition is disposed of.
