Prayer in Crl.OP.24433/2015: Criminal Original Petition is filed under Section 482 of Cr.P.C., praying to direct the respondents to secure the accused persons in connection with Crime No.427 of 2015 on the file of the 2nd respondent forthwith.
Prayer in Crl.OP.912/2016: Criminal Original Petition is filed under Section 482 of Cr.P.C., praying to direct the respondent herein not to harass the petitioner and his family members on the guise of enquiry. For Petitioner :Mr.M.Silambarasan in Crl.OP(MD).No.23566/15 & 24433/15 Mr.C.Jeganathan, in Crl.oP.(MD) No.912/2016 For Respondents :Mrs.S.Prabha Government Advocate(Crl. Side) COMMON ORDER When the matters are taken up for hearing, the Government Advocate (crl.side) appearing for the respondent police, on instructions, would submit that the case in Crime No.427 of 2015 has been closed as mistake https://hcservices.ecourts.gov.in/hcservices/
of fact and the closure report to that effect has not been produced before the Magistrate concerned.
2. In view of the submission made by the Government Advocate (crl.side), the Crl.OP.(MD)No.23566 of 2015 is closed. The respondent Police is directed to produce the closure report before the Magistrate concerned, within a period of two weeks from the date of receipt of a copy of this order.
3. In view of the order passed in Crl.OP.(MD)No.23566 of 2015, the relief sought in Crl.OP(MD)No.24433/2015 and Crl.OP.(MD)No.912 of 2016 become infructuous and accordingly, these Criminal Original Petitions are dismissed as infructuous.
