Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused 7 & 8, in Crime No.164 of 2015 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 294(b), 323, 506(i) and Section 4 of Tamilnadu Prohibition of Harassment of Women Act and hence, seek anticipatory bail.
2. The learned counsel for the petitioners submitted that this Court on 11.08.2015 granted anticipatory bail to the petitioners on condition to execute a bond for a sum of Rs.10,000/- with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned. He would further submit that the petitioner could not comply with the condition imposed by this Court within the stipulated time and hence, the anticipatory bail petition was dismissed automatically. Thereafter, the petitioner filed Crl.O.P.(MD) No.22110 of 2015 and the said petition was dismissed for non-prosecution on 01.12.2015 and now the petitioners have come out with the present petition on the ground that the petitioners are ladies and they could not execute sureties and he prayed for grant of anticipatory bail to the petitioners.
https://hcservices.ecourts.gov.in/hcservices/ 3.The learned Government Advocate(Crl.side) would submit that the injured has treated as out-patient and the co-accused A1 to A6 were
already released on anticipatory bail by this Court in Crl.O.P.(MD) No.13882 of 2015.
4. Considering the facts and circumstances of the case and considering the fact that the petitioners were already granted anticipatory bail by this Court and they could not execute the sureties, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Vilathikulam, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m for a period of two weeks and thereafter, as and when required for interrogation.
The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
