O R D E R

The petitioner was a candidate who took part in the selection process for the post of Executive Engineer IV included in Group VIII services. The petitioner questions the recruitment Notification No.22/2016 dated 25.11.2016. A number of grounds have been raised. But, the petitioner will have to be non suited for the simple reason that the challenge to the recruitment notification has been made after taking part in the selection process and after being unsuccessful in the selection.

2.As rightly pointed out by the learned standing counsel appearing for the respondent commission, as held by the Hon'ble Supreme Court in the decision reported in (2002) 6 SCC 127, (Chandra Prakash Tiwari V. Shakuntala Shukla), in the event a candidate appears at the interview and particapates therein, only because the result of the interview is not "palatable" to him, he cannot turn round.
