ORDER

This writ petition has been filed for a Mandamus, seeking for a direction to the respondents to include the petitioner's name in the Family Ration Card, in which the third respondent has been shown as Head of the Family.

2.According to the petitioner, she is the legally wedded wife of the third respondent and the fourth respondent is a concubine for the third respondent. According to her, the third respondent has removed her name in the Family Ration Card and included the name of the fourth respondent. The petitioner has given representations on 02.02.2021 and 17.11.2021, seeking to include her name in the Family Ration Card.

3.It is also the case of the petitioner that due to the exclusion of the petitioner from the Family Ration Card, she has been unable to get free rice and foodgrains meant for poor. She has also expressed financial difficulty for supporting her son for want https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.[MD]No.3253 of 2022 of Family Ration Card. It is also her case that earlier her name was included in the Family Ration Card, but thereafter, it has been illegally removed at the behest of the third respondent, her husband. She has given the aforementioned representations seeking for inclusion of her name in the Family Ration Card. 4.Admittedly, the said representations have not been considered till date. No prejudice would be caused to the respondents, if the petitioner's representations seeking for inclusion of her name in the Family Ration Card, in which the third respondent, her husband is Head of the Family, are considered on merits and in accordance with law, after affording fair hearing to the petitioner, third and fourth respondents and any other necessary party. 5.

For the foregoing reasons, this Court directs the first and second respondents to consider the petitioner's representations dated 02.02.2021 and 17.11.

(12) weeks from the date of receipt of a copy of this order. 6.With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
