Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the 1st respondent to dispose the petitioner's application dated 25.09.2017 seeking to rectify the mistake crept in during UDR survey and remove the classification of S.No.1285/5 as lane and classify the same as petitioner's patta land within a time frame as fixed by this Court.

ORDER

The writ petition has been filed seeking a direction to the first respondent to dispose of the application dated 25.09.2017 filed by the petitioner.

2.According to the petitioner he is the owner of the property in Survey Nos.1285/3, 1285/4 and 1285/5 and during UDR survey, Survey No.1285/5 has been wrongly classified as lane. Based on the wrong classification, now the eviction proceedings is pending against the petitioner. Now the petitioner filed an application before the first respondent and the same is pending from September 2017. Since no order has been passed on the above said application, the present Writ Petition has been filed by the petitioner.

3.Considering the fact that the application filed by the petitioner is pending form September 2017, without going into the merits of the case, this Court directs the first respondent to consider and pass orders on the application filed by the petitioner on merits and in accordance with law, after giving opportunity to the petitioner and other rival parties, if any, within a period of six weeks from the date of receipt of a copy of this order. 4.With the above said direction, this Writ Petition is disposed of.
