ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 406, 420 and 120-B of IPC Section 5 of TNPID Act in C.C.No.1 of 2014 on the file of the Special Court of TNPID Act cases, Madurai, the petitioners/A2 and A3 have approached this court for anticipatory bail under Section 438 of the Code of Criminal Procedure.
2. Heard both sides.

The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case and Non Bailable Warrant is issued on 16.07.2014 in C.C.No.1 of 2014 on the file of the Special Court of TNPID Act cases, Madurai. Hence, the petitioners have come forward with this application for anticipatory bail.
4.Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners. However, at the request of the learned counsel for the petitioners, the petitioners are directed to surrender himself after issuing proper notice to the learned Public Prosecutor appearing before the lower Court, within 10 days from the date of receipt of a copy of this order before the Special Court of TNPID Act cases, Madurai, and to file an application for bail and in the event of filing such an application, the learned Judge is directed to consider the bail application on the same day on merits. With the aforesaid direction, this Criminal Original Petition is dismissed.
