ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 406, 420, 306 of IPC in C.C.No.30 of 2013 on the file of the Judicial Magistrate No.II, Kovilpatti the petitioner/A1 has approached this court for anticipatory bail under Section 438 of the Code of Criminal Procedure.

2. Heard both sides.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent person and he has been falsely implicated in this case and Non Bailable Warrant is issued on 12.12.2014 in C.C.No.30 of 2013 on the file of the Judicial Magistrate No.II, Kovilpatti. Hence, the petitioner has come forward with this application for anticipatory bail.

4.Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. However, at the request of the learned counsel for the petitioner, the petitioner is directed to surrender himself after issuing proper notice to the learned Public Prosecutor appearing before the lower Court, within 10 days from the date of receipt of a copy of this order before the https://hcservices.ecourts.gov.in/hcservices/ Judicial Magistrate No.II, Kovilpatti, and to file an application for bail and in the event of filing such an application, the learned

Magistrate is directed to consider the bail application on the same day on merits.

With the aforesaid direction, this Criminal Original Petition is dismissed.
