Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 6(4) of TNSTC (RDCS) Order 1982 r/w Section 7(1) a (ii) of Essential Commodities Act, in Crime No.128 of 2015 on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that on 06.07.2015 at 03.15 a.m., the defacto complainant while on vehicle check up, intercepted the vehicle bearing No.

TN 75 4214 and on enquiry, they informed that they are transporting the vegetables and also produced the bills. While the defacto complainant verifying the bills, immediately, they started the vehicle and escaped from the scene of occurrence. The defacto complainant chased the vehicle and A1 & A2 left the vehicle and ran away from that place. Subsequently, they were arrested.

3.The case of the petitioner is that he is innocent person and he has not committed any offence as alleged by the prosecution and he is working as a Salesman in the Ration Shop and he has been falsely implicated on the basis of the confession given by the other accused. 4.The learned Government Advocate (Crl.side) submitted that the petitioner is working as a Salesman in the Ration shop and co-accused were arrested and released on bail.

5.Considering the facts and circumstances of the case and also considering the fact that co-accused were arrested and released on bail, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned https://hcservices.ecourts.gov.in/hcservices/

Judicial Magistrate No.I, Thoothukudi and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.
