ORDER

This petition has been filed to quash the impugned Charge Sheet in STC No.145 of 2026 on the file of the Judicial Magistrate Court No.I, Dindigul. 1/5

2. The case of the prosecution is that on 19.01.2026, at about 12.00 p.m, the accused herein and another accused are said to have used filthy language against each other in front of the police station. Hence, a case in Crime No.27 of 2026 was registered against the accused for the offence under Section 75 of Tamil Nadu City Police Act, 1888. After completion of the investigation, a final report was filed before the Judicial Magistrate Court No.I, Dindigul, and the same taken on file in STC No.145 of 2026. Challenging the same, this petition has been filed.

The learned counsel for the petitioner submitted that only the petitioner along with his mother had gone to the respondent police station to lodge a complaint with respect to a family dispute and they have not done anything wrong. But, the Police had registered a case in Crime No.27 of 2026 for the offence under Section 75 of Tamil Nadu City Police Act, 1888, and the same was culminated into filing of the charge sheet in STC No.145 of 2026 before the Judicial Magistrate Court No.I, Dindigul. Hence, he sought the indulgence of this Court.

4. The learned Government Advocate (CrlSide) appearing for the respondent police submitted that they have caused disturbance to the public and 2/5

they have abused the public and created great disharmony in the locality and hence, FIR came to be registered against the accused. Hence, he prayed for dismissal of the petition.

5. Heard both sides and perused the materials available on record.

6. A careful reading of the charge sheet would make it explicit that the petitioner has shouted in the public place with filthy language, creating great disgust to the common public. However, it is understood that the defacto complainant is not a public or a police officer. Accordingly, the proceedings against the petitioner is liable to be quashed.

7. Accordingly, the Criminal Original Petition is allowed and the impugned Charge Sheet in STC.No.145 of 2026 on the file of the Judicial Magistrate Court No.I, Dindigul, is hereby quashed and consequently, the connected miscellaneous petition is closed.
