ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 19.12.2014 for the offences punishable under Sections 406 and 420 of I.P.C. in Crime No.509 of 2014 on the file of the respondent police, seeks bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.

3. This Court, while granting interim bail to this petitioner on 11.02.2015, passed the following order:

"It is the case of the prosecution that this petitioner and her husband Manikandan started a concern by name Sri Krishna Real Estate at Rajapalayam and they gave advertisement in various papers assuring that if people pay monthly instalement of Rs.280/-, at the end of the 50th month, they will register plots in the name of the subscribers. There are about 645 depositors in this case, who have been cheated to the tune of Rs.85 lakhs. This Court has granted interim anticipatory bail to the petitioner's husband P.Manikandan in Crl.O.P.(MD). No.1050 of 2015 on 29.01.2015 on condition that he shall cooperate with the investigation and settle the claims of various subscribers. The interim anticipatory bail is granted up to 12.02.2015.

4. The learned counsel for the petitioner submits that the petitioner is willing to give her property and settle the various subscribers and he produced a photo copy of the sale deed document No.1417 of 2009 and said that she will sell this property and settle the various depositors.

5. In view of this undertaking, interim bail is granted to the petitioner for a period of three weeks till 04.03.2015." https://hcservices.ecourts.gov.in/hcservices/

4. The petitioner came out on interim bail and was not keeping up her undertaking given by her and on the contrary, learned counsel for the petitioner was pleading for extension of interim bail.

5. This Court gave a long rope to the petitioner by extending the interim bail from 04.03.2015 to today. Till now, the petitioner has not kept up her undertaking given by her.

6. Under such circumstances, this Court is not inclined to further extend the interim bail and the Criminal Original Petition is dismissed. The petitioner shall surrender immediately before the concerned Magistrate failing which the respondent police shall take her into custody and produce her for remand before the concerned Magistrate. sd/- 20/03/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
