Crime No.474 of 2014 ... RESPONDENT/COMPLAINANT For Petitioner : M/S.S.XAVIER RAJINI Advocate For Respondent : Mr.A.P.BALASUBRAMANI, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147,148,341,294(b), 323, 324 and 307 IPC in Crime No.474 of 2014 on the file of the respondent police, seek anticipatory bail.
2. Heard the submissions made on either side.
3. This is the second anticipatory bail application and the first petition in CRL OP(MD) No.21912 of 2014 was dismissed by this court on 12.12.2014 by a well considered order. 4.The learned counsel for the petitioners submits that the injured has been discharged from the hospital with very simple injuries and, therefore, this occurrence becomes suspect. 5.Just because the injured had escaped death, it cannot be inferred that the case has been a foisted one. It is seen that the first petitioner-D.Bees Kutti @ Muniachamy has got three cases, M.Arun-third petitioner has got four cases and L.Sureshfourth petitioner has got eight previous cases. It is also represented that S.Karthick-second petitioner has been arrested. Hence, the anticipatory bail application with regard to him is closed. As regards the petitioners 1,3 and 4, in view of the allegations levelled against them and in view of the previous cases https://hcservices.ecourts.gov.in/hcservices/
against them, I am not inclined to grant anticipatory bail to them and hence, this Criminal Original Petition is dismissed. sd/- 06/01/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
