Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order in Ref.No.C1/110/2018 dated 22.01.2018 passed by the third respondent and quash the same and consequently direct the third respondent to reinstate the petitioner in the post of Associate Professor, department of Physics in the third respondent college.

*********** Heard the learned counsel on either side.

2.The petitioner is employed in the third respondent College. The petitioner has been suspended by an order dated 22.01.2018. The order of suspension is questioned on the ground that there is no resolution passed by the college Committee. This contention raised https://hcservices.ecourts.gov.in/hcservices/

by the writ petitioner is not controverted by the learned counsel appearing for the third and fourth respondents. In fact, the learned counsel for the third and fourth respondents would submit that they shall withdraw the order of suspension impugned in this writ petition.

2.This submission is recorded. Since the order of suspension has been withdrawn, necessarily the petitioner will have to be reinstated in service. It is of course open to the third respondent to proceed against the writ petitioner in the manner known to law. 3.With this liberty, this writ petition is allowed. No costs.
