ORDER
This Criminal Original Petition has been filed seeking direction to the third respondent to withdraw the case in Crime No.182 of 2019 dated 23.09.2019 registered under Section 420 of IPC on the file of the fifth respondent and entrust the same to the fourth respondent for an investigation of the case by a Competent Officer and file final report before the Jurisdictional Magistrate. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) for the respondent Police. 3.The learned Government Advocate (Crl. Side) would submit that based on a complaint given by one Thankamani, the fifth respondent police has registered a case in crime No.182 of 2019 for the offence under Section 420 IPC. She would further submit that the fifth respondent police has duly conducted investigation in a fair manner.
She would further submit that if the petitioner has any grievance against the fifth respondent, a direction may be issued to the Superior Officer to monitor the investigation. 4.At this Juncture, the learned counsel appearing for the petitioner would submit that it is suffice that a direction may be issued to the fifth respondent to complete the investigation and file final report within a stipulated time and to the Deputy Superintendent of Police, Thuckalay, Kanyakumari District to monitor the investigation.
5.Considering the submission made by the learned Government Advocate (Crl. Side), a direction is issued to the fifth respondent to complete the investigation in Crime No.182 of 2019 and file final report as expeditiously as possible, preferably, within a period four months from today and Deputy Superintendent of Police, Thuckalay, Kanyakumari District to monitor the investigation done by the fifth respondent in Crime No.182 of 2019. 6.With the above directions, this Criminal Original Petition stands disposed of. Consequently, the connected Crl.M.P.(MD).No.1823 of 2020 stands closed.
