Respondents Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to consider and pass orders on merits and in accordance with law on the appeal dated 24.05.2017 filed by the petitioner aggrieved against the non-inclusion of petitioner's name in the seniority list in the proceedings of the second respondent in Na.Ka.A3/9675/2014 dated 20.04.2017, by taking into account the entry level seniority of the petitioner in the service, without reference to the year of completion of basic training and departmental examination after giving personal hearing to the petitioner within a time frame as fixed by this Court.

ORDER

Heard the learned counsel on either side.

2.By consent of both the parties, the main Writ Petition itself is taken up for final disposal.

3.The petitioner is working as Assistant in the Revenue Department, Pudukottai District. He is aggrieved by the inter se seniority list for promotion from the post of Junior Assistant from the eligible candidates to the post Of Deputy Tahsildar. The petitioner's name has been omitted. It has to be included in the said list. Therefore, the petitioner filed an appeal on 24.05.2017 before the first respondent.

4.The learned counsel for the petitioner submits that the petitioner is due for retirement next year and therefore there is urgency in the matter. Considering the same, the first respondent is directed to dispose of the appeal, dated 20.04.2017 within a period of four weeks from today.
