Respondents Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent herein to pass appropriate order in connection with the departmental proceedings initiated in PR 112/1999 and 118/1999 and consequently disburse all retirement benefits to the first petitioner and the second petitioner within the time stipulated by this Court. Heard the learned counsel on either side.
2.By consent of both the parties, the main Writ Petition itself is taken up for final disposal.
3.The petitioners were employed in the Police Department. They were implicated in a criminal case, but the same ended in acquittal as early as on 24.04.2012. But the disciplinary action initiated way back in the year 1999 is yet to be concluded. 4.Therefore, the first respondent is directed to conclude the departmental proceedings initiated against the petitioners vide PR 112/1999 and 118/1999 within a period of twelve weeks from today. https://hcservices.ecourts.gov.in/hcservices/
The question of disbursement of the retirement benefits will of course depend on the outcome of the said proceedings. 5.With this observation, the Writ Petition stands allowed. No costs.
