O R D E R
This writ petition is filed by the petitioner to direct the second respondent to conduct enquiry and dispose the petitioner's complaint dated 23.01.2025.
2. According to the petitioner, he lodged an online complaint to the first respondent as against one Rajmohan for forging of signature in the sale agreement, but the same has not been considered. Hence, he filed this petition to take action as against the complaint dated 23.01.2025.
3. The learned Additional Public Prosecutor (Criminal Side) would submit that already they received the online complaint dated 23.01.2025 and the same was forwarded to Marthandam Police for taking appropriate action.
4. At this juncture, the learned counsel for the petitioner would submit that the complaint is pertaining to the District Crime Branch, Nagercoil, but the complaint was forwarded to Marthandam Police. Therefore, this Court can pass appropriate orders. Page No. 2 of 4
5. Considering the nature of prayer sought in this petition, this Court without issuing notice to the private respondents no.3 to 6 inclined to pass orders.
6. According to the petitioner, he lodged a complaint, but the same has not been considered. According to the second respondent, the first respondent / Superintendent of Police forwarded the complaint to the Marthandam Police for enquiry. In view of the same, it is appropriate to direct the petitioner to appear before the Marthadnam Police for enquiry and if the Marthandam Police found that the case comes under purview of the second respondent, they can transfer the case to the second respondent. Thereafter, if any complaint received by the second respondent, they can take action and dispose the same within fifteen [15] days in accordance with law.
7. With the above said direction, this writ petition is disposed of. No costs.
