Respondents PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to issue a direction directing the respondent No.2 to withdraw the case in Crime No.150 of 2019 dated 12.08.2019 registered under Section 174 Cr.P.C, on the file of the Respondent No.4 and entrust the same to Respondent No.3 for an investigation of the case by a Competent Officer and file a final report before the Jurisdictional Magistrate.

O R D E R

The Criminal Original Petition is filed to direct the respondent No.2 to withdraw the case in Crime No.150 of 2019 dated 12.08.2019 registered under Section 174 Cr.P.C, on the file of the Respondent No.4 and entrust the same to Respondent No.3 for an investigation of the case by a Competent Officer and file a final 1/3

report before the Jurisdictional Magistrate.

2.The learned Government Advocate (Criminal Side) would submit that the on the complaint given by one Periyar Venthan, a case been registered in Crime No.150 of 2019 and the respondent police has filed final report as ' Action Dropped' and the case has been closed.

3.At this juncture, the learned counsel for the petitioner would submit that the respondent police has not served R.C.S. Notice on the petitioner sofar.

4.Recording the said submission made by the learned Government Advocate (Criminal Side), this Criminal Original Original Petition is closed as nothing survives for adjudication. Consequently connected miscellaneous petition is also closed. However, the respondent police is directed to serve RCS notice to the petitioner.
