Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.P.GANAPATHI SUBRMANIAN, Advocate for the petitioner and of M/S.M.ASHA, Government Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed to suspend the sentence imposed on the petitioner/Accused No.1 by the learned Sessions Judge, (Full Additional Charge), Mahila Court, Pudukkottai, in S.C.No.61 of 2020, dated 28.12.2021.
2.The petitioner involved in a case in Crime No.70 of 2012 for the offence under Section 306 of I.P.C and the same was taken on file in S.C.No.61 of 2020 on the file of the learned Sessions Judge, https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.2581 of 2022 (Full Additional Charge), Mahila Court, Pudukkottai. The learned Sessions Judge, (Full Additional Charge), Mahila Court, Pudukkottai, found the petitioner guilty under Section 306 of I.P.C and sentenced him to undergo ten years rigorous imprisonment and to pay a fine of Rs.50,000/-, in default, to undergo one year rigorous imprisonment. The petitioner has filed the application for suspension of sentence pending disposal of the said appeal.
3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.
4.Earlier the petitioner filed a petition in Crl.M.P(MD)No.774 of 2022, seeking to suspend the sentence and this Court by an order dismissed the petition on 28.01.2022.
