RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to pass an order condoning the petitoner`s absence on 01.11.2021 and on subsequent months till the filing of this petition before the court below in pursuance of the order of this Hon`ble Court as made in Crl.M.P. (MD) No. 7546/2019. Prayer in CRL A(MD). 376/ 2019 :

Pleased to set aside the judgment and conviction dated 20.08.2019 by the Spl.Court for Trial of PC Act Cases, Madurai in Spl.C.No.43 of 2011.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.BABU JAGANATH.R., Advocate for the petitioner and of Mr.R.MEENAKSHI SUNDARAM, Additional Public Prosecutor on behalf of the Respondent, the Court made the following order:- This petition is filed to pass an order condoning the petitioner's absence on 01.11.2021 and on subsequent months till the filing of this petition before the court below in pursuance of the order of this Court made in Crl.M.P(MD) No.7546 of 2019 in Crl.A. (MD) No.376 of 2019, dated 27.08.2019.

2. The learned counsel for the petitioner would submit that the petitioner is aged about 74 years and this Court vide order dated 27.08.2019 in Crl.M.P(MD) No.7546 of 2019 in Crl.A(MD) No. 376 of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.2723 of 2022 2019, suspended the sentence, by imposing a condition that the petitioner should appear before the trial Court on the first working day of every month at 10.30 a.m. He would further submit that the petitioner was regularly complying with the condition and appear before the trial Court till 1.10.2021, but due to the sudden demise of the petitioner's son on 29.10.2021, he was not able to appear before the trial court on 01.11.2021. Hence he come up with the aforesaid prayer.

3. Considering the age of the petitioner, the condition imposed by this Court in Crl.M.P(MD) No. 7546 of 2019 in Crl.A(MD) No. 376 of 2019, dated 27.08.2019, is modified, and shall appear once in two months the absence of the petitioner before the trial Court on the particular date is also condoned.
