As the approval petition filed under Section 33(2)(b) of the Industrial Disputes Act, 1947 was rejected through the impugned order in the main Writ Petition dated 29.12.2023 and the respondent No.2/Writ Petitioner has not chosen to reinstate the petitioner, it is obligatory on the part of the respondent No.2/Writ Petitioner to pay the last drawn wages in terms of Section 17(b) of the Industrial Disputes Act, 147 to the petitioner from the date of rejection of the approval petition i.e., 29.12.2023 and continue to pay the same pending disposal of the main Writ Petition. Hence, there shall be an interim direction, directing the respondent No.2 herein to pay the last drawn wages to the petitioner herein with effect from 29.12.2023.
