For Petitioner : Mr.M.Ramu For Respondents : Mr.N.Ramesh Arumugam Govt. Advocate 1/5
ORDER
This writ petition is filed to quash the impugned refusal check slip in RFL/Chinna Dharapuram/8/2025 dated 27.01.2025 issued by the second respondent and to direct the respondent to register the power deed dated 27.01.2025 presented by the petitioner.
2. The case of the petitioner is that the property measuring an extent of 4 acres 61 cents, comprised in S.No.603, situated at Punjai Kalakurichi Village, Karur Taluk, and District, belonged to one Palaniyappa Pillai. The said Palaniyappa had purchased the said property vide Doc. No. 1076/1970. Palaniyappa Pillai passed away in 1973. His family members partitioned the property by way of a registered document in Doc. No. 1172/1973. In terms of the said partition deed, the above mentioned property fell to the share of the writ petitioner.
3. The writ petitioner, after having enjoyed the property, claims to have executed a power of attorney in favour of one Somasundaram, son of Karuppanna Gounder. The document was executed on 27.01.2025. The respondent refused to register the document on the ground that, in the parental partition deed in Doc. No.1172/1977, the 2/5
name of the village was mentioned as 'Nanjai Kalakurichi' instead of 'Punjai Kalakurichi.' Hence, the respondent issued a refusal check slip. Challenging the same, the present writ petition came to be filed.
4. When the matter was taken up for admission, I pointed out to Mr.M.Ramu, that unless and until, the petitioner amends the partition deed, he would not be in a position to identify the property. I relied upon Section 21(1) of the Registration Act r/w 162 (III) of the Registration Rules. Finding this difficulty, Mr.M.Ramu stated that he would present document for rectification of the partition deed.
5. Today, when the matter was taken up, Mr.M.Ramu represented that the rectification deed had been registered in Doc. No. 639/2025 on 03.03.2025. In terms of the rectification deed at page No.12, it is clear that the name of the village has been changed from "Nanjai Kalakurchi" to "Punjai Kalakurichi."
6. As the parent document has been amended from 03.03.2025, the impugned refusal check slip in RFL/Chinna Dharapuram/8/2025 dated 27.01.2025 issued by the second respondent is set aside. There shall be a direction to the respondents to register the power deed dated 27.01.2025 presented by the petitioner in favour of 3/5
Somasundaram, within a period of two weeks from the date of uploading of this order.
7. With the above directions, this writ petition is allowed. No costs.
