O R D E R
This petition has been filed seeking to call for the records pertaining to impugned order Na.Ka.No.23/Kaa.Thu.Ka/Ko/2026 dated 02.02.2026 issued by the 2nd respondent and quash the same as illegal, consequently, to direct the 2nd respondent to permit the petitioner to conduct ''Adal Padal'' Cultural Program in ''Therku Ilandaikulam Mariamman Temple'', Therku Ilandaikulam Village, Kayathar Taluk Thoothukudi District on 05.02.2026 from 5.00 p.m., onwards and to provide adequate police protection .
2. The learned counsel for the petitioner submitted that the respondents have refused to grant permission for conducting the cultural programme on the 2/6
ground of law and order problem.
3. The learned Government Advocate (Criminal Side) submitted that there is a law and order problem in the area.
4. But there is no evident that the same would create law and order problem. It is seen that no such evidence is available and that there is no FIR registered in respect of the previous years. Therefore, the impugned order passed by the second respondent is set aside.
5. The petitioner is directed to file an affidavit of undertaking before the respondent police stating that no obscene dance shall be performed and no vulgar words shall be used in the cultural programme. Further, the cultural programme shall be videographed by the respondent police at the cost of the petitioner. In the event of any obscene dance being performed by the petitioner, this Court will take appropriate action upon the petitioner.

Upon such undertaking, the 2nd respondent is directed to permit the petitioner to conduct the cultural programme in ''Therku Ilandaikulam Mariamman Temple'', Therku Ilandaikulam Village, Kayathar Taluk Thoothukudi District, on 05.02.2026 at 05.00 p.m., to 10.00 p.m., and to provide adequate police protection.
