COMMON ORDER This matter is listed today under the caption for being mentioned at the instigation of the learned counsel for the petitioner. 2.When the matter is taken up for hearing today, the learned counsel for the petitioner would submit that the petitioner has filed an application to withdraw 10% of the deposited amount before the concerned Court and the learned Magistrate has returned the petition on the ground that the petitioner has not produced any order permitting to withdraw 10% of the deposited amount. Even according to the learned Magistrate, the petitioner has already filed an application to withdraw 20 % of the deposited amount and as of now 10% of amount is remaining. This Court has passed an order, dated 25.02.2025 and without considering the above, the learned Magistrate has passed the impugned return, which cannot be sustained.

3.
