PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the Impugned order in his proceedings in Na.Ka.A6/2502/2024 dated 07.09.2024 on the file of second respondent and to quash the same and further directing the Respondents 1 to 4 to remove the encroachment made by the fifth respondent in Survey No.162 situated at Maayanur village, Krishnarayapuram Taluk, Karur District.

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ petition has been instituted challenging the order passed by the Revenue Divisional Officer, Kulithalai, holding that encroachments are identified and actions are directed to be initiated to evict the encroachers under the Tamil Nadu Land Encroachment Act, 1905.

2. The learned counsel for the petitioner would submit that the fifth respondent is an encroacher and encroached upon the Government Poramboke land.
3. The learned counsel for the fifth respondent per contra would submit that the petitioner himself is an encroacher.
4. It is needless to state that all the encroachments are to be removed by following the procedure as contemplated under the Tamil Nadu Land Encroachment Act, 1905.
5. The learned Additional Government Pleader for the respondents 1 to 3 based on the written instructions, would submit that the encroachments are identified and the authorities are already initiated action, which is in progress.
6. That being the submission, the respondents 1 to 3 are directed to follow the procedure as contemplated under the Tamil Nadu Land 3/6
Encroachment Act, 1905 and remove the encroachments, if any identified. The said exercise is directed to be completed within a period of eight weeks from the date of receipt of a copy of this order. The petitioner as well as the fifth respondent are at liberty to submit the documents, if any along with the explanations to the competent authority.
