ORDER

The petitioner seeks for a Writ of Mandamus to direct the respondent to allow the petitioner to carry the passengers to the parking way of Nagerkovil Railway Station on the basis of his documents in the form of permit, license and police certificate and his application dated 14.12.2024.

2. The respondent is managing the Nagerkovil Town Railway Station. The station was upgraded, to a Block Station, allowing stoppage for more trains. Hence, the respondent called for applications for issuance of license for Auto Rickshaws and Taxis from 07.12.2022 onwards. The petitioner had made an application on 09.04.2024. Feeling aggrieved over the fact that it has not been considered, the petitioner has come forward with the present writ petition.

3. When the matter came up for admission, I requested Mr.K.Govindarajan, learned Deputy Solicitor General, to get instructions from the Railway Division, Thiruvandrum regarding the relief sought for by the petitioner. He has produced the instructions and records. 2/5

4. I have carefully considered the submissions of both sides. I have gone through the records.

5. The respondent has produced a register styled "NJT Autos Priority Register". In the said register, the petitioner's name is found in serial No.79. The instruction that has been produced by Mr.K.Govindarajan points out that the Railway Authorities have issued Cart license to applicants from Serial Nos.1 to 25 on 04.01.2024 and from Serial Nos. 26 to 50 on 24.09.2024. As of now, they have given 50 such licenses.

Mr.K.Govindarajan states that whenever there is an increase in the number of trips or trains, that halt at Nagerkovil, the Department will consider the increase in the licenses granted to the persons like the petitioner. He states that the seniority of the NJT Autos Priority Register maintained will be strictly followed. He states that as and when the petitioner's seniority comes up for consideration, the authority will consider the same in accordance with law.
