Prayer in CRL MP(MD). 7696/2017 IN CRL OP(MD) No.6591 of 2017: To condone the absence of 3 days (i.e) 03/07/2017, 10/07/2017, 17/07/2017 of the petitioners before the respondent police which conditions imposed in Crl.O.P(MD).No.6591/2017 dated 06/06/2017.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.T.Kanimozhi, Advocate for the petitioner and of Mr.A.Ramar, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- The learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondent Police are present.
2.It is seen that earlier on 08.08.2017 the learned Additional Public Prosecutor submitted that the 1st petitioner failed to appear from 12.07.2017 onwards and the 2nd petitioner appeared only from 03.07.2017 to 31.07.2017. Hence, this Court by order dated 08.08.2017 directed the petitioners to appear before the respondent Police from 14.08.2017 onwards till the disposal of this petition. However, the petitioners, without complying with the said condition, have filed a petition in Crl.M.P.(MD)No.7696 of 2017 to condone the https://hcservices.ecourts.gov.in/hcservices/
absence of 3 days i.e., 03.07.2017, 10.07.2017 and 17.07.2017 during the pendency of Crl.M.P.(MD)No.6636 of 2017 for relaxing the earlier conditions imposed in the Criminal Original petition. The learned Additional Public Prosecutor further submitted that the petitioner failed to appear on 14.08.2017 as directed by this Court in the order dated 08.08.2017.
3.In view of the above, this Court is not inclined to condone the absence of the petitioners as well as relaxing the conditions. Accordingly, these petitions are dismissed and the respondent Police is directed to take steps for cancelation of anticipatory bail petition of the petitioners.
