ORDER

This Criminal Original Petition is filed by the petitioner to direct the respondent-police to expedite the investigation and file the final report in connection with Crime No.312 of 2023 dated 15.10.2023 on the file of the respondent-police.

2. The learned counsel appearing for the petitioner would submit that in this case FIR has been registered on 15.10.2023, but no investigation is conducted in a fair manner and not filed final report. Hence this petition.

3. The learned Additional Public Prosecutor appearing for the respondent seeks two (2) months time to complete the investigation. The investigation in this case is under process and some of the witnesses have to be examined, therefore, seeks two (2) months time.

4. This Court has considered the rival submissions advanced by the learned counsel for the petitioner and the Additional Public Prosecutor for the respondent and perused all the materials available on record.

5. In this case, the FIR was registerd on 15.10.2023 for the offences under Sections 448, 427 & 379 of IPC. However, even after one and a half years, the respondent-police have not completed the investigation. Therefore, considering the nature and circumstances of the case and in order to give one more chance to the respondent, this Court is inclined to grant two (2) months time to complete the investigation and to file final report, in this case.

6. In the result, with the above said observations, this Criminal Original Petition stands ordered.
