Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 406, 409, 420 read with 120(b) of the Indian Penal Code in C.C.No.5 of 2015, on the file of the learned Chief Judicial Magistrate, Madurai, seek anticipatory bail.

2. It is submitted by the learned counsel for the petitioners that due to the absence of the petitioners, non bailable warrant was issued against the petitioners on 05.10.2015, by the learned Chief Judicial Magistrate, Madurai.

3. The learned Government Advocate (Crl. Side) submitted that due to absence of the petitioners for hearing, non bailable warrant was issued against the petitioners and the petitioners may be directed to approach the Court for recalling the warrant.

4. Considering the fact that non bailable warrant was issued against the petitioners for their absence, there shall be a direction to the petitioners to surrender before the learned Chief Judicial Magistrate, Madurai, and to file a petition for recalling the warrant and the learned Chief Judicial Magistrate, Madurai, is directed to consider the same on the same day and pass orders on merits in accordance with law.
