Respondents Prayer: This Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the respondent No.1 to withdraw the case in Crime No.133 of 2019 from the file of the respondent No.4 and to entrust the same to the 2nd respondent and consequently to direct the 2nd respondent to appoint a competent police officer to investigate the same and file final report before the competent court in accordance with law within the time stipulated by this Court.

The petitioner seeks transfer of investigation of Crime No.133 of 2019 registered on the file of the fourth respondent herein. 1/3
2.The petitioner's father was found dead in a pond at Neiveli Thenpathi village on 06.10.2019. Thereupon Crime No.133 of 2019 was registered under Section 174 of Cr.P.C.
3.The petitioner's counsel reiterated the various contentions set out in the memorandum of the petition and called upon this Court to transfer the investigation.
4.The learned Government Advocate (Crl. Side) pointed out that the postmortem did not reveal any external injury. The petitioner's father is said to have died of heart attack. It is relevant to note here that the petitioner did not lodge any man missing complaint following the disappearance of his father. It was only the police who informed the petitioner about the his father death. 5.After carefully considering the contentions of the petitioner and after going through the materials on record, I am of view that no case has been made out for transferring the investigation. The fourth respondent is directed to file the final report before the Jurisdictional Court within a period of six weeks from the date of receipt of a copy of this order.
6. With this direction, this criminal original petition stands dismissed.
